FACTS:

1. WBAI LSB election results were finally certified on April 7, 2008
2. WBAI PNB reps were previously elected on an interim basis pending
the above certification
3. WBAI has interim PNB reps, the majority of whom (3 out of 4)
support the Justice and Unity Coalition
4. 3 PNB reps requested that the WBAI delegates to hold a special
delegate meeting prior to the Houston PNB meeting this weekend for
the purpose of electing new and permanent PNB delegates

I am counsel for the plaintiffs in the above referenced action and I write due to serious distortions of fact and law that were made to you by your interim Executive Director and General Counsel, Dan Siegel, at a session of the meeting of the Pacifica National Board held in Newark, New Jersey on January 26, 2008. I write to correct the record and, simultaneously, to demonstrate that, due to his conflict of interest, Mr. Siegel is an unreliable source of legal advice and facts about this lawsuit. In referring to statements made by Dan Siegel, I am operating from a transcript of his statements.

Since the public session of the PNB meeting last night (2/15/08) at which this would probably have been an agenda item never took place, I am writing this brief report of an incident that occurred at the station (WBAI) on 2/14/08.

As Directors of the Pacifica Foundation, Joe Wanzala (KPFA) and I had planned a director's inspection to look at some financial records, among others, and Joe appointed Eve Moser as his agent to accompany me on the inspection. I was looking for information on many issues, including why our expenses were so high, what the protocol for signing checks was, how much the use of a "fulfillment house" to send out premiums was costing us, and what had been done to implement the latest WBAI Recovery Plan proposed by the CFO. In short, trying to "follow the money."
